1. Agreement

These Terms of Use ("Terms") govern your access to and use of PNCH, including the PNCH mobile app, website at getpnch.com, workouts, videos, plans, and premium features.

PNCH is operated by a sole professional based in the United Arab Emirates ("PNCH", "we", "us", or "our"). By using PNCH, you agree to these Terms. If you do not agree, do not use PNCH.

2. Fitness And Safety

PNCH provides general fitness and workout information. It is not medical advice, diagnosis, treatment, physical therapy, or a substitute for professional healthcare guidance.

• Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have a medical condition, injury, disability, are pregnant, or have concerns about exercising.
• Stop exercising immediately if you feel pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptom.
• You are responsible for choosing safe space, equipment, intensity, and movements suitable for your condition and ability.
• Results vary. PNCH does not guarantee weight loss, fitness improvement, health outcomes, or specific results.

3. Eligibility

You must be at least 16 years old to use PNCH. If local law requires a higher age or parental consent, you may use PNCH only if those requirements are met.

4. App Access

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use PNCH for your own personal, non-commercial fitness training.

You may not copy, modify, reverse engineer, resell, redistribute, scrape, or misuse PNCH or its content except where applicable law expressly allows it.

5. Free And Premium Features

PNCH may offer free content and paid premium features. Premium availability, included content, prices, trial offers, and billing periods may vary by country, marketplace, storefront, promotion, and time.

We may add, remove, update, or replace workouts, videos, plans, features, and offers from time to time.

6. Subscriptions And Purchases

• Subscription prices, billing periods, renewal terms, and trial details are shown before purchase in the app or by the relevant marketplace.
• If you purchase through Apple, payment is charged to your Apple Account and subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• If you purchase through an authorized alternative marketplace or payment provider, payment, renewal, cancellation, and refund rules are handled by that provider's terms and interface.
• You are responsible for managing or canceling your subscription through the marketplace or provider used for the purchase.
• Refunds, chargebacks, billing disputes, trials, renewal timing, taxes, and unused portions of subscription periods are handled according to the relevant marketplace or payment provider rules and applicable law.

7. Acceptable Use

You agree not to:

• Use PNCH unlawfully, fraudulently, or in a way that harms other users, us, or third parties.
• Interfere with app security, subscriptions, entitlement checks, APIs, servers, or marketplace purchase flows.
• Use automated systems to access, copy, or extract PNCH content or data.
• Remove copyright, trademark, or proprietary notices from PNCH content.

8. Intellectual Property

PNCH, including its name, app design, text, images, videos, workouts, plans, software, and other content, is owned by us or our licensors and is protected by intellectual property laws. No rights are granted except the limited use rights described in these Terms.

9. Third-Party Services

PNCH depends on third-party services such as app stores, marketplaces, payment providers, analytics providers, attribution providers, hosting providers, and device operating systems. We are not responsible for third-party services, outages, terms, policies, pricing, or decisions.

10. Privacy

Your use of PNCH is also governed by our Privacy Policy, which explains how we handle personal data.

11. Availability And Changes

PNCH may be interrupted, delayed, changed, suspended, or discontinued at any time. We may update these Terms from time to time. If changes are material, we will provide notice where required. Continued use of PNCH after changes means you accept the updated Terms.

12. Disclaimers

PNCH is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement.

13. Limitation Of Liability

To the fullest extent permitted by law, PNCH and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or lost opportunity arising from or related to your use of PNCH.

Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnity

You agree to defend and hold harmless PNCH and its operator from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of PNCH, violation of these Terms, or violation of law or third-party rights.

15. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law rules, except where mandatory consumer protection laws provide otherwise. Disputes will be handled by courts or authorities with competent jurisdiction in the United Arab Emirates unless applicable law requires a different forum.
